Terms of Service

1. Description of Services

Upavāsa is an intermittent-fasting tracking and guidance app that helps users:

• Plan and track fasts across science-based protocols (16:8, 18:6, 20:4, OMAD, Extended, or custom).
• Monitor fasting-stage progress (glycogen depletion, ketosis, autophagy) and fasting history/streaks.
• Optionally receive Ayurvedic/yogic ("Ancient Wisdom") guidance alongside their fasting plan.
• Sync fasting-relevant biomarkers with Apple Health / Health Connect.
• Record voice check-ins, reviewed as transcribed text.
• Optionally follow a generated, multi-week guided Challenge Plan (Pro tier).

2. Eligibility & Account Registration

• Age: You must be at least 18 years of age to create an account and use the Services.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials, including any biometric login keys stored on your device.
• Accuracy: You agree to provide accurate, complete, and up-to-date information during onboarding and profile configuration.

3. Subscriptions, Billing, & Refunds

• Fees: Access to Plus/Pro features (unlimited fasting, advanced analytics, autophagy/metabolic reports, the search & knowledge library, and Challenge Plans) requires a paid subscription.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date through the Apple App Store or Google Play Store.
• Refunds: Transaction processing, billing, and refunds are handled directly through the Apple App Store or Google Play Store.

4. User Conduct & Content Restrictions

You agree not to:

• Violate any applicable laws, regulations, or third-party rights.
• Upload malicious code, reverse-engineer, or attempt to compromise the security of our APIs, servers, or client databases.
• Submit voice check-ins containing defamatory, abusive, or illegal material.
• Use the Platform to simulate or substitute professional medical treatment, diagnosis, or advice.

5. Intellectual Property

All content, design assets, algorithms, code, and branding (including "Upavāsa" and "Kriyacode Technologies LLC") are the exclusive property of Kriyacode Technologies LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on your mobile device for personal use only.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Services will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Kriyacode Technologies LLC, its affiliates, officers, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or in connection with your use of the Services.

8. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of your jurisdiction, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved exclusively through binding arbitration.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date above and publishing the revision within the Application.
